Dino Melaye vs Smart Adeyemi: INEC gives update on use of card readers during Saturday’s Kogi rerun election



The Independent National Electoral Commission (lNEC) says it will continue to use and deploy the Smart Card Reader(SCR) in all elections, including that of Saturday’s rerun election in Kogi West Senatorial District, Ajaokuta Federal Constituency and Sabuwa State Constituency.
The Commission disclosed this in a statement issued by its National Commissioner and Chairman, Information and Voter Education Committee, Mr Festus Okoye, on Thursday in Abuja, NAN reports.
INEC said that the clarification became necessary in the light of remarks attributed to Okoye at a programme by the Situation Room, which gave the impression that Smart Card Readers were no longer useful in the electoral process.
“To the contrary, the National Commissioner spoke in the context of attempts by some political interests to willfully by-pass the Smart Card Reader (SCR) during elections to inflate their votes.
“They do this against the backdrop of the Supreme Court decision that the SCR is not to be used exclusively to determine over-voting.”
It explained that the commission introduced the SCR in the electoral process principally as an additional confirmatory and authentication tool.
It added that the tool was to determine the authenticity of cards presented by voters and eliminate impersonation, which were serious challenges to the electoral process in Nigeria.
INEC said that the SCR was designed to strengthen the integrity of the electoral process and eliminate multiple voting.
“In accordance with Section 49(1 & 2) of the Electoral Act, 2010 (as amended) and Clause paragraph 10(a) of INEC Regulations and Guidelines for the Conduct of Elections, a person intending to vote with his voter’s card shall be verified to be the same person on the Register of Voters by use of the Card SCR.
“Furthermore, by paragraph 10(bi of the said Regulations and Guidelines. “Any Poll Official who violates the provisions of paragraph 10(a) relating to the use of the Smart Card Reader shall be deemed to be guilty of an offence and shall be liable to prosecution”.
It reminded political parties, candidates, poll agents and the electorate that resistance to the use of the SCR and obstruction and resistance to the deployment/distribution of electoral materials constituted unlawful truncation of the electoral process.
The commission warned that consequently zero votes would be entered for the affected polling unit.
“The commission will continue to work with the National Assembly and all the critical stakeholders to reduce malpractices in our electoral process, including over voting.
“As part of this process, strengthening the legal basis of the use of the SCR, as well as other amendments that will advance the electoral process would be vigorously pursued.
“The commission will also continue to work with the security agencies and other stakeholders to prevent individuals and/or groups from undermining the use and application of the Smart Card Reader in elections.”

Magu: Buhari Keeps Lobbyists In Suspense As Battle For EFCC Top Job Steps Up.

The intense lobbying for the chairmanship of the Economic and Financial Crimes Commission (EFCC) has heightened since the return of President Muhammadu Buhari from his private time in London.
Lobbyists seeking to get their nominee to replace acting EFCC Chairman Ibrahim Magu, have recommended two Commissioners of Police (CPs) for the position.
Some governors are also said to be among those against Magu’s substantive appointment.
President Buhari is, however, keeping his decision on Magu to his chest while his body language is giving sleepless nights to the arrowheads behind the plot to remove Magu.
But Buhari may have to take a decision on Magu on or before December 4 when the Federal High Court in Abuja will deliver judgement on the consolidated suits challenging the continued stay of Magu.
If President Buhari decides Magu’s fate before December 4, he would have beaten the court to it and make the judgment an academic exercise.
Magu was appointed by President Buhari on November 9, 2015. But the Eighth Senate under former Senate President Bukola Saraki twice declined to confirm his nomination.

A source confided to our correspondent that influential individuals have brought the names of the two CPs (names withheld) to the Villa on many occasions for the President’s consideration.
The source said: “It is an open secret in the Villa that those against Magu have not relented. They took the two CPs to an Emir, asking him to prevail on the President to choose one of them as Magu’s replacement.
“But the royal father declined and politely told them to take the gentlemen to the President themselves since they also have access to him.
“But the President is taking his time on the matter. He is not unmindful of the stellar performance of the EFCC under the watch of Magu in terms of remarkable convictions and recoveries of stolen assets.”

It was also gathered that some governors and lawmakers are not happy with the idea of Buhari re-presenting Magu for confirmation.
They alleged that Magu “does not weigh political implications of some of the investigations being conducted by the EFCC.”

These governors and senators from the ruling APC and opposition PDP were said to be uncomfortable with the retention of Magu on the grounds that the anti-corruption czar would move against them once his confirmation process is concluded.
The senators were said to be apprehensive of Magu’s incorruptible stance on corruption matters. A governor, who spoke in confidence, said: “There is no doubt about it, the acting chairman of EFCC has done well, but the problem with Magu is that he does not appreciate that he is working in a political environment.
“If there are delicate issues at hand, Magu proves difficult. Fighting corruption in an environment like this requires some tact and diplomacy.
“The EFCC chairman has not been sparing those who are even making a strong case for his substantive appointment.”

But some stakeholders have argued that there is the need for Buhari to forward Magu’s name without further delay.
They also insisted that the retention of Magu would enable him to complete certain sensitive cases for the benefit of the country.
It was gathered that Justice Ijeoma Ojukwu of the Federal High Court in Abuja will rule on the suits against Magu before her on Dec 4.
The judgment will be on consolidated suits challenging Magu’s stay in office in acting capacity.

Justice Ojukwu adjourned to decide Magu’s fate after the court heard and adopted final briefs of argument in five separate suits bordering on the legality or otherwise of his tentative leadership of the anti-graft agency.
Whereas four of the suits that came up for hearing prayed the court to declare Magu’s stay in office as illegal since his nomination by President Muhammadu Buhari was twice rejected by the Senate, the fifth suit urged the court to hold that he could validly remain as the Acting Head of the agency despite Senate’s decision against him.
Defendants in the case are President Buhari, the Attorney-General of the Federation and Minister of Justice, Mr. Abubakar Malami (SAN), the Senate, as well as Magu and the EFCC.
Though a total of 12 legal actions were filed before the court after President Buhari gave Magu the nod to remain in office, notwithstanding the rejection of his nomination, seven of them were subsequently struck out for want of diligent prosecution.
The court in 2017 consolidated all the suits, based on a joint application that was filed by President Buhari and the AGF.
Sections 2 and 3 of the EFCC (Establishment Act) 2004 on the composition of EFCC and appointment of chairman read in part: 2: (l) The Commission shall have a chairman who shall be the Chief Executive and Accounting Officer of the Commission, who should be a serving or retired member of any government security or law enforcement agency not below the rank of Assistant Commissioner of Police or equivalent, among other conditions.

EFCC: Case against Olisa Metuh hits another huddle

An FCT High Court, Maitama, on Wednesday fixed Jan. 27, 2020 for the hearing of a case against Olisa Metuh, a former PDP spokesman, charged with criminal destruction of evidence to open his defence.
Metuh was arraigned alongside his company, Desita by the Economic and Financial Crimes Commission (EFCC ) in January 2015 on a two-count charge bordering on alleged destruction of evidence.
The case slated for the commencement of defence on Wednesday was further adjourned at the instance of the court.
NAN reports that the council on the matter were all present, the defendant, Metuh was also present but the court did not sit and date was agreed on by all the parties.
Justice Ishaq Bello, on Oct. 17, in his ruling on the no-case- submission filed by Metuh, ordered him to enter defence.
He said a prima facie case was established against him by the prosecuting counsel, Mr Sylvanus Tahir.
Bello said that the “view of this court” after reviewing arguments by parties, “is that the application for a no-case -submission is lacking in merit. It is hereby dismissed.”
He thereby ordered Metuh to enter his defence and adjourned the trial until Nov 20 for the defendant to open his defence.
Metuh’s counsel, Dr Onyechi Ikpeazu, SAN, had on Oct. 10, 2017, told the court that they would enter a no-case submission at the close of the prosecution’s case.
Arguing in the no-case submission, Ikpeazu had told the court that the prosecution had not established any case to warrant the defendant to be called to enter his defence.
He said that the application was in pursuant to the provisions of Sections 302 and 357 of ACJA.
The counsel added that the defendant had a constitutional liberty and could not be prosecuted where he either refused to make a statement or withdraw any part of his writing in the course of making a statement.
Ikpeazu said that the defendant also had a right to cancel any part of his statement voluntarily.
He reminded the court that the charge by EFCC was that Metuh destroyed his statement and obstructed EFCC officials by willfully tearing his statement.
Ikpeazu argued that a piece of paper not signed did not qualify as a statement by the defendant, and urged the court to discharge and acquit the defendant.
However, the prosecuting counsel Mr Sylvanus Tahir, urged the court to establish whether or not a prima facie case had been made against the defendant
Tahir added that cancellation was different from tearing which was obstruction, and prayed the court to call upon the defendant to enter his defence.

EPL: Redknapp advises Mourinho on first player to sign for Tottenham Hotspur


Former Tottenham Hotspur manager, Harry Redknapp, has advised the club’s new manager, Jose Mourinho to make a move for Real Madrid winger, Gareth Bale following his appointment.
Mourinho was appointed as the new manager of Tottenham on Wednesday morning following the sack of Mauricio Pochettino.

But Redknapp wants the former Chelsea and Manchester United manager to sign Bale, adding that it will get him on the right track at Spurs.

“It would be an opportunity for Mourinho to bring back Gareth Bale. Yes, certainly what a signing it would be for the club,” Redknapp told talkSPORT.

“That would get him on side straight away. The fans would love that.
“That would be an amazing move for him.”
Bale spent six years at Tottenham before leaving the London club for Real Madrid in 2013 for a then world-record £85 million.

The 30-year-old scored 55 goals in 203 appearances for Tottenham, including 21 Premier League goals in 33 games in his last season.

The Wales international also won the PFA Young Player and Player of the Year awards during his time at Spurs.

EPL: Man Utd’s Wan-Bissaka tops Premier League tackling table ahead of Ndidi, others


Manchester United defender, Aaron Wan-Bissaka is currently on top of the Premier League tackling table ahead of Leicester City midfielder, Wilfred Ndidi.
Wan-Bissaka, who joined Man United from Crystal Palace last summer, has won more tackles than any other player in the Premier League so far this season.
The right-back has won 35 tackles and his closest competitor is Leicester City’s Ricardo Pereira, on 31 tackles, while Ndidi is third place with 29 tackles.
Man United made this known in a statement on their official website on Wednesday.
The statement read: “Impressively, Wan-Bissaka has won more tackles than any other player in the Premier League this season, winning the ball 35 times during his 10 top-flight appearances as a Red.
“That stat is more notable when considering the fact that Aaron has actually missed two of our league outings, against Arsenal and Newcastle United, due to an injury.
“Heading into Sunday’s match at Sheffield United, Wan-Bissaka is top of the ‘tackles-won’ table and his closest competitor is Leicester City’s Ricardo Pereira, on 31.

EPL: John Terry breaks silence on blocking Aguero’s move to Chelsea


Former Chelsea captain, John Terry, has denied that he blocked the club from signing Sergio Aguero early in 2010.
 
Earlier this week, there were reports that the Blues were keen to sign Aguero, while he was still at Atletico Madrid and even made a £30million offer.
Terry allegedly told Chelsea’s power brokers to instead sign David Villa.
He has, however, rubbished such speculation.
 
“Where do these stories come from?” Terry posted on his Instagram story.
“If they bothered calling player’s agents, it would solve an awful lot of nonsense!”
